MAGISTRATE’S FINDINGS AND RECOMMENDATION

Plaintiff brings this action on her own and, purportedly, on behalf of her son, as the child’s mother and next friend. The child has been declared a dependent child, and has been under the state court’s supervision since his placement with foster parents several years ago.
