On behalf of the appellants it is contended that the common council in adopting the resolution providing for a reconveyance of the property, acted without authority under the statute, and attempted to usurp power granted only to the board of school directors, and that the mayor and city clerk acted within the rights and duties of their respective offices when they questioned the action of the common council and declined to sign and deliver the deed as directed.
