OPINION

By J. J. P. CORRIGAN, J.:

Plaintiff, a resident of the City of Brooklyn, has instituted this action to have a declaratory judgment entered determining that a certain Ordinance designated as Ordinance No. 1945-17, passed on July 23, 1945, is unconstitutional and void and of no force and effect.

Ordinance No. 1945-17 reads as follows:

“AN ORDINANCE PROHIBITING THE RAISING, KEEPING, MAINTAINING, OR HARBORING OF PIGEONS, CHICKENS, DUCKS, GEESE, TURKEYS, GUINEA HENS, RABBITS, MICE, PIGS, SHEEP, COWS, HORSES, GOATS, OR ANY BIRDS, FOWL, RODENTS, OR ANIMALS DETRIMENTAL TO PUBLIC HEALTH AND…
