MEMORANDUM-DECISION AND ORDER
SCULLIN, Chief Judge.
I. INTRODUCTION
On November 20, 1998, Plaintiffs served Defendants, the New York State Department of Environmental Conservation (“DEC”), and the Environmental Protection Agency (“EPA”) with a Notice of Intent to Sue. On March 31, 2000, Plaintiffs filed their complaint in this action. See Dkt. No. 1. On October 6, 2000, this Court dismissed Plaintiffs’ turbidity and thermal discharge claims for failure to state a claim. See Dkt. No. 19.
