OPINION
{¶ 1} Appellant, Arlin Joseph Murphy, appeals from the February 14, 2003 judgment of the Lake County Court of Common Pleas, in which he was labeled a sexual predator and sentenced for sexual battery.
{¶ 2} On June 14, 2002, appellant was secretly indicted on two counts of rape, felonies of the first degree, in violation of R.C.2907.02(A)(1)(b), and three counts of gross sexual imposition, felonies of the third degree, in violation of R.C. 2907.05(A)(4).
