ERICKSTAD, Chief Justice.

This case comes before us on the plaintiff’s motion to dismiss the appeal pursuant to Rule 27 of the North Dakota Rules of Appellate Procedure. The motion to dismiss is denied.

The plaintiff, Reed E. Sanford, and the defendant, Glenda L. Sanford, were married in 1955. Irreconcilable differences arose between the parties and a judgment of divorce was entered in Cass County District Court on July 5, 1979.
