MEMORANDUM OPINION

MICHAEL, District Judge.

Following his dismissal from his post as administrative assistant to the superintendent of the Albemarle County public schools, plaintiff filed this action under 42 U.S.C. §§ 1981 and 1983, alleging violations of his rights to due process of law and equal protection of the laws. He also charged certain defendants with conspiring to deprive him of his civil rights. This matter is now before the court on defendants’ motion to dismiss under Rule 12(b)(6) of the Federal Rules of Civil Procedure. The parties have submitted materials outside the pleadings…
