Complaint by appellants to quiet title to 40 acres of land, hereinafter referred to as “tract 1.” Appellee Alva A. Kemp filed a cross-complaint, alleging that he was the owner of the undivided one-half of this land, that the land was indivisible, and asking that his title be quieted and for partition.
