In an action to recover damages for failure to timely file a notice of attachment, plaintiff and the defendant Sheriff cross-appeal from a judgment of the Supreme Court, Orange County, entered February 25, 1976, after a nonjury trial, as follows: (1) the Sheriff from so much of the judgment as is in favor of plaintiff and (2) plaintiff from so much of the judgment as awarded him only nominal damages. Judgment reversed, on the law, and new trial granted as between the parties to this appeal, limited to the issue of damages only, with costs to abide the event. Plaintiff was owed $4,000 by one…
