The petitioner, Annie Bonds, instituted this proceeding under Sections 1270 to 1272 inclusive, Code of 1942, to have herself declared one of the heirs at law of Martin Bonds, Sr., deceased, who was at the time of his *355death on March 9, 1941, a resident citizen and householder of Tunica County, Mississippi, and who then owned in fee simple and occupied as his homestead and place of residence the SW% of the SE% of Section 30, Township 4, Range 10 West in said county.
