MEMORANDUM OPINION AND ORDER

SunTrust Bank, N.A. (“SunTrust”) appeals the Bankruptcy Court’s August 6, 2009 Order denying SunTrust’s motion for summary judgment and granting summary judgment for Appellee John A. Northen (“Northen”) and Marc and Maryann Macky (the “Mackys”). 1 In re McCor mick, 417 B.R. 362 (Bankr.M.D.N.C.2009). The parties have briefed the appeal, and a hearing was held on June 23, 2010. For the reasons below, the Order of the Bankruptcy Court is affirmed.
