Plaintiff-landowner, George Daraban, asserted that the defendant Bedford Township’s ordinance unconstitutionally zoned his land for single-family residence and asked that the defendants be permanently enjoined from interfering with the construction of apartment houses on his land. The trial court granted the requested relief and the Court of Appeals affirmed.

This appeal asserts that the issuance of the injunction against interfering with the construction of apartment houses on plaintiff’s land is judicial zoning and hence improper.
