This is an appeal from a judgment of the county court of Cotton county, wherein the plaintiff in error was charged with and convicted of the crime of transporting intoxicating liquor, with his punishment assessed at confinement in the county jail for a period of six months and a fine of $500.
Frank Boles, an undersheriff of Cotton county, for the state, testified that about 10 o’clock at night he was down near the depot and saw a car approach — quoting from his testimony :
