Writ of Error to the Circuit Court of Pulaski county. The Hon. W. H. Feild, Circuit Judge, presiding. The Circuit Court erred in refusing to take jurisdiction of this case. See Dig. Ark. page 313. 6 Eng. Rep. 604, Carnall vs Crawford county.

delivered the opinion of the Court.

At the October term, 1852, of the county court of Pulaski county, certain proceedings, to which Couch was a party, touching a public road, were finally decided adversely to him. He took a bill of exceptions, filed an affidavit, and prayed an appeal to the Circuit Court, which the County Court granted. On the 6th of December following, a certified transcript of the proceedings was filed in the Circuit Court, and on the 20th of January, 185#; on motion of the attorney general, Couch being present and resisting, the Circuit Court dismissed the…
