MEMORANDUM OPINION ON MOTION FOR JUDGMENT AS A MATTER OF LAW

This matter is before the Court on a motion for judgment as a matter of law filed by Defendant Hilton Hotels Corporation (hereinafter “Hilton”). See Dkt. # 73 (hereinafter “Mot.”). Defendant owns and operates the Washington Hilton in Washington, D.C., where Plaintiff, Mesafint Beyene, has been a room service waiter since 1999. See Joint Pretrial Statement (Dkt. # 54) at 2.
