Judgment unanimously modified, on the facts, and, as modified, affirmed, without costs, in accordance with the following memorandum: Both plaintiffs (the Barnums) and defendants (the Frickeys) claim they own the same parcel of real estate bordering Lake Ontario in the Town of Sodus. The subject property consists of a wooded lot and is improved by a two-story cottage. The Barnums claim they purchased the property in September 1980 pursuant to a contract with defendant Lee Sundsted.
