This cause comes before us on appeal because of the reinstatement of plaintiff’s bill in the above entitled cause after an order of dismissal had been previously entered therein.

On May 6, 1932, the plaintiff filed a bill in equity against the defendant, and on November 29, 1932, defendant filed its answer. On December 2, 1932, plaintiff filed a replication and on motion of plaintiff the cause was referred to a master in chancery on February 1, 1933.
