The first ground of exception in this case which was insisted on by the counsel for the defendant on the argument was the admission of testimony tending to show an agreement between Hplbrook, the former administrator of the plaintiff’s intestate, and James Wilson, the defendant’s grantor, for a submission of the matters in dispute as to their respective rights in the premises to arbitration, and that James Wilson should continue in possession until a decision was made by the arbitrators, and also the decision and charge of the court upon the evidence so offered and received.
