The defendant moves for an order pursuant to the Criminal *695Procedure Law to seal his 2002 conviction, by plea, for third-degree sale of a controlled substance. The statute provides that a defendant who has completed his sentence and has successfully completed a judicial diversion program “or another judicially sanctioned drug treatment program of similar duration, requirements and level of supervision” is eligible to have the conviction conditionally sealed.
