Plaintiff Donald Mac Pherson (“Plaintiff’ or “Mac Pherson”) brought the present suit after the foreclosure of his property by Defendant State Street Bank and Trust Company (“Defendant” or “State Street”). Plaintiff asserts that he was not served with proper notice prior to the foreclosure and, thereby, was deprived of his Fourteenth Amendment right to Due Process.
