DAVIDSON, Presiding Judge.

Appellant was convicted of manslaughter, his punishment being assessed at five years confinement in the penitentiary.

The killing occurred in the town of Spur, in Dickens County, just before Christmas. Appellant lived several miles from where the tragedy occurred, and had gone to the town of Spur on the day of the killing, which occurred at night. He and deceased, King, and others were together.
