QUARLES, J.
At the conclusion of the evidence on behalf of the plaintiff (now defendant in error), at the first trial, the circuit court entered judgment of nonsuit, in favor of the defendant (now plaintiff in error), to review which, the plaintiff sued out a writ of error in this court, and the judgment- of nonsuit was reversed. We will here refer to the former decision of this court (ante page 66) as showing the material facts.
