This was an action brought in the district court of Box Elder County to have a deed absolute in form declared a mortgage, and the same foreclosed.

The material allegations of the complaint, in substance, are: That in 1904 the defendant Godfrey Anger had borrowed from the Utah Mortgage & Loan Company, of Logan, Utah, $2,170, and had given, as security therefor, a first mortgage-lien on the premises involved in this action; that on January 17, 1917, the defendants procured additional loans aggregating $2,000 from the Ogden State Bank, for which they gave their promissory notes, signed by the…
