Appeal by defendant from a judgment of the Supreme Court, Richmond County, rendered November 14, 1978, convicting him of sodomy in the first degree and burglary in the second degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, after a hearing, of defendant’s motion to suppress a showup identification by the complainant. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and the case is remitted to Criminal Term for a new trial which shall be preceded by a Wade hearing to determine whether there exists an…
