Perlowski v. Elson T. Killam Associates, Inc.
New Jersey Superior Court Appellate Division
1Opinion of the Court
DERMAN, P.J.Cv.
The question presented is whether in-house counsel authorized to perform work for other clients may bring a discrimination claim and a whistleblower claim. This determination will require the *470court to determine if the attorney is an employee or an independent contractor.
If the court does not find that plaintiff is an employee, it must then determine if the law against discrimination provides an attorney any protection from termination of his services or if a client is free to terminate an attorney for any reason, even a discriminatory one.
