The Jury Charge on the Issue of Negligence

Defendant’s first argument on appeal is that the trial court failed to properly instruct the jury on the issue of negligence. The trial court instructed:

*377What is negligence? It’s a lack of ordinary care. It’s a failure to do what a reasonably careful and prudent person would have done, or the doing of something which a reasonably careful and prudent person would not have done; considering all of the circumstances existing at the time in question and on the occasion in question.
