The verdict was based on legally sufficient evidence (see People v Danielson, 9 NY3d 342, 348-349 [2007]). There is no basis for disturbing the court’s credibility determinations. Defendant was properly convicted under the statutory standards for a misdemeanor prosecution of a corporation based on the conduct of its agents (see Penal Law § 20.20 [2] [c]). The evidence supports the inference that defendant’s employees, “acting within the scope of [their] employment and in behalf of the corporation,” committed acts constituting reckless endangerment in the second degree.
