Petitioner appears pro se throughout this proceeding. This cause arose when petitioner filed a petition for Writ of Habeas Corpus in the La Porte Circuit Court on December 23, 1977.

The record shows that petitioner, Omer Young, Jr., was sentenced from the Fulton Circuit Court by the Honorable Wendell C. Tombaugh, on April 19,1976, to an indeterminate term of from not less than one (1) nor more than ten (10) years for the offense of assault and battery with intent to commit a felony, rape.
