On February 17, 1909, Frederick L. Fuller, an able and experienced inventor, made a contract (Exhibit A of the *235complaint) with the plaintiff (hereinafter called the “ National Company ”), whereby he was employed “ in the capacity of inventor for a period of one year commencing the 15th day of March, 1909,” at a salary of $5,000. His reciprocal covenant was not to serve for the year, but to enter the employment and to give his entire time “ while this contract is in effect ” to inventing and experimental work.
