Upon a further consideration of the ruling of the court in admitting in evidence the original affidavit by Sheriff Bowden over the objection and exception of defendant, we have reached the conclusion that there was prejudicial error in this ruling. It affirmatively appears without conflict that the question of the "time" of the alleged commission of the offense, therein charged, was not in controversy. There was no dispute upon the question that, if the offense here complained of was committed at all, it was in the month of December, 1924, at defendant's home in Monroe county. The only…
