— Reversing.

The appellant, Andy Williams, was convicted in the Leslie circuit court of the crime of false swearing and punished by three years confinement in the penitentiary. The alleged false oath as a foundation for the indictment was the testimony given by appellant at the trial of the same election contest involved in the ease of Elvin Williams, whose conviction for a similar offense was reversed by us on September 26, 1941, in the ease of Wil liams v.
