Edwin L. Freudenstein filed a complaint in the circuit court of De Witt county to construe the will of John H. Miller, deceased. The plaintiff was the surviving husband of one of the children and devisees of John H. Miller, and among other things claimed that the child of his wife, who was then deceased, had a vested interest in certain property devised under the will of the said Miller, which he inherited upon the child’s death, as heir.
