Memorandum Opinion

DIANE WEISS SIGMUND, Bankruptcy Judge.

Before the Court is the Motion for Relief from the Automatic Stay Under 11 U.S.C. § 363(d)(1), or in the Alternative, Motion for Declaratory Relief (the “Motion”) filed by John J. Sutton Jr. (“Sutton”) and Rappa Real Estate (“Rappa” and together with Sutton, “Movants”). An evi-dentiary hearing was held, and all briefs have been filed. The matter is now ripe for decision.
