BROWN, Associate Justice.

The city of Paris is a municipal corporation, created by special act of the Legislature, approved March 27, 1889, of which we quote below that part material to the determination of the questions presented in this case, as follows:

“ The city council shall be invested with full power and authority to grade, pave, repair, or otherwise improve any avenue, street, alley, or other highway, or any portion thereof within the limits of said city, whenever by a vote of two-thirds of the aldermen elected they may deem such improvement for the public interest; two-thirds of the…
