The appellant sued the appellee for the price of two carloads of the Michigan Alkali Company soda ash, and at the conclusion of the plaintiff’s testimony the Court below instructed the jury that the plaintiff had offered no evidence legally sufficient to show any contract, either express or implied, between the plaintiff and the defendant or to show any-contract upon which the plaintiff can maintain the suit in his. own name against the defendant.
