This is an action of tort for loss of consortium and for criminal conversation. The defendant’s exceptions were sustained by this court after jury verdicts for the plaintiff in the amount of $45,000. Kaye v. Newhall, 356 Mass. 300. Upon retrial the jury returned verdicts for the plaintiff in the amount of $2,500, and the case is now before us on the plaintiff’s exceptions. The material evidence summarized in our prior opinion was in large part identical to that in the second trial, and need not be repeated here except so far as is necessary to the discussion of the exceptions before us.
