This matter comes before the court on Defendant’s Motion for Judgment on the Pleadings and plaintiffs opposition thereto. Plaintiff, the Rosebud Sioux Tribe (the “Tribe”), leased Tribal lands in Mellette County, South Dakota for fifteen years to Sun Prairie, a Nebraska general partnership, for the construction and operation of several pork production facilities (the “Project” or “Land Lease”).
