Samuel C. Cason, sometimes hereinafter referred to as the defendant, was on the seventh day of February, 1942, arrested and charged with the illegal transportation of ardent spirits contrary to the provisions of The Alcoholic Beverage Control Act of this State [Virginia Code, 1942, (Michie) section 4675 (38a)].
