Herky, LLC and JHB Properties, Inc. (“Developers”) appeal the trial court’s judgment affirming the State Tax Commission’s (“Commission”) dismissal of Developers’ challenges to property assessments. We reverse.
I. BACKGROUND
The relevant facts are not in dispute. The Developers acquire and develop land in order to sell it to residential home builders. As of January 2005, Herky owned 146 properties and JHB owned 83.
