PERRY, Judge.

In this case, we review the summary dismissal of an application for .post-conviction relief. After reviewing the record and the application filed below, we affirm.

In May of 1992, Robert January was convicted of one count of attempted sexual abuse of a child under the age of sixteen. I.C. § 18-1506. He was sentenced to a determinate term of seven and one-half years. The sentencing court, however, retained jurisdiction so that January could be evaluated as a candidate for probation at the North Idaho Correctional Institution (NICI).
