MERRITT, Circuit Judge.
In this § 1983 action, plaintiff Tze-Pong “Raymond” Ku claims that the State of Tennessee deprived him of his right to procedural due process when it placed him on leave of absence from his third year of studies at East Tennessee State University’s James H. Quillen College of Medicine. The district court denied Tennessee’s motion for summary judgment and instead granted summary judgment to the plaintiff.
