delivered the unanimous opinion of the Court.

This action was brought by the plaintiff against the defendant to recover damages in the sum of Twenty-Five Hundred Dollars for the alleged destruction of a mercantile business in which he claimed to own a half interest, and for the loss of certain personal property.
