After a jury trial in the Northampton Division of the District Court Department, the defendant, Christopher Magdalenski, was convicted of one count of assault and battery in violation of G. L. c. 265, § 13A, against his sister, Bethany Magdalenski. In an unpublished memorandum and order pursuant to Appeals Court rule 1:28, the Appeals Court affirmed the conviction. Commonwealth v.
