_JjJn this action for damages, the plaintiff, Gus Rico, claims that the Sewerage and Water Board and the City of New Orleans are liable for damages sustained as a result of an accident allegedly cause by a manhole cover located at the 1500 block of Carondolet. After a bench trial, the trial court found the defendants liable and apportioned each fifty percent fault. The defendants lodged separate appeals asserting the trial court was manifestly erroneous in its finding of fact as to how the accident occurred; the trial court was manifestly erroneous assessing 50% liability…
