This cause came on to be heard upon a Motion for New Trial or to Amend Judgment filed by the plaintiff, Burger King Corporation, pursuant to Rule 923 of the Rules of Bankruptcy Procedure.

On May 2, 1980 the defendant filed a petition under Chapter 11 of the Bankruptcy Code. Since that time the debtor has continued in possession of its property and has continued to operate its business without the intervention of a trustee.
