The appellant was tided by a jury and convicted in the district court of Shawnee County, Kansas, of the crime of grand larceny as defined in G. S. 1957 Supp., 21-533, for the theft of an automobile. Following the overruling of his motion for a new trial, the appellant was sentenced to the Kansas State Penitentiary for a term of not less than ten years in accordance with the provisions of G. S. 1949, 21-534 and 21-107a upon his stipulation that he had been previously convicted of the crime of grand larceny. The appellant was represented by…
