PRENDERGAST, Judge.

The appellant was indicted and convicted for the murder of Mrs. Marie Rudolph on May 13, 1909, and the death penalty assessed.

A brief statement only of the case is made. The deceased and her husband were elderly people living on a farm in the country alone. They were last seen alive late in the evening of May 13, 1909, in their field at their home. Sometime during the night their residence was burned, and it seems that no one is shown to have seen the house burn, and the neighbors knew nothing of it until the next morning, when they discovered it had been burned the night…
