The Supreme Court granted a writ of error in this case to settle the conflict between the decisions of certain courts of the state relative to the duty of a trial judge, when not requested to do so, to give a charge limiting the effect of testimony admissible only for a special purpose. In reversing the decision of this court, the Supreme Court ordered the case returned here for the purpose of having this court determine the question of the sufficiency of the evidence to sustain the judgment for appellee.
