'The history of this litigation is as follows:
On June 27, 1916, plaintiff sued the Eisher Oil Company, as maker, and G. B. Zigler, as indorser, on a certain promissory note for $11,682.25, with interest 'and attorney’s fees. Zigler answered. His codefendant did not.
The ease was tried, and on April 12, 1917, the district court gave judgment against both defendants in solido, notwithstanding no preliminary default had been entered against the Eisher Oil Company.
On April 25, 1917, defendant Zigler appealed devolutively to this court.
