On March 8, 1958, Ellsworth J. Bidder, an inmate of the Eastern State Penitentiary, petitioned the Court of Common Pleas of Lackawanna County for a writ of habeas corpus. The petition was dismissed by Judge Eagen without hearing, and Bidder has appealed.

The record discloses that appellant participated in a series of burglaries in Scranton and Clarks Summit. He was arrested on January 11, 1952, at which time he was identified by one of his accomplices. On the same day appellant himself identified another participant.
